By using our services, you agree to abide by these rules and guidelines, which outline your rights.

These Terms and Conditions ("Terms") govern your use of Palpable's AI assistant services, applications, and website ("Services") provided by Enthoosa Inc., Wyld Hill Pty Ltd trading as Enthoosa, and their affiliates (collectively "Palpable," "we," "us," or "our"). By using Palpable, you agree to these Terms. If you disagree, do not use our Services.

1. Acceptance and Eligibility By accessing Palpable, you represent that you are at least 18 years old, have legal capacity to enter binding contracts, and accept these Terms. Corporate users warrant they have authority to bind their organization.

2. Service Description Palpable provides an AI-powered voice assistant that integrates with third-party services to execute tasks. Service availability, features, and integrations may change without notice. We do not guarantee uninterrupted or error-free service.

3. Account and Security

  • You are responsible for maintaining account security and all activities under your account

  • You must provide accurate information and promptly update changes

  • You must immediately notify us of unauthorized access

  • We may suspend or terminate accounts for security reasons without liability

4. Authorized Use You may NOT:

  • Use Services for illegal, harmful, or fraudulent purposes

  • Reverse engineer, decompile, or attempt to extract source code

  • Resell, sublicense, or provide Services to third parties

  • Overload, disable, or impair Service infrastructure

  • Use automated systems to access Services beyond normal use

  • Violate third-party rights or terms of integrated services

  • Use Services to process sensitive personal data without authorization

5. Third-Party Integrations

  • You authorize Palpable to access integrated services on your behalf

  • You are responsible for compliance with third-party terms

  • We are not liable for third-party service changes, outages, or actions

  • Third-party data handling is subject to their privacy policies

6. Payment Terms

  • Subscription fees are billed in advance and non-refundable

  • Prices may change with 30 days notice

  • Failed payments may result in service suspension

  • You are responsible for all applicable taxes

7. Intellectual Property

  • Palpable retains all rights to our Services, technology, and content

  • You retain ownership of your data

  • You grant us license to process your data to provide Services

  • Feedback and suggestions become our property without compensation

8. AI Services Disclaimer

  • AI responses are automated and may contain errors

  • Do not rely on Services for medical, legal, financial, or safety-critical decisions

  • You are responsible for reviewing and verifying all AI-generated actions

  • We are not liable for decisions made based on Service outputs

9. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES

  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES

  • WE ARE NOT LIABLE FOR LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION

  • OUR TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE PRECEDING 12 MONTHS

  • THESE LIMITATIONS APPLY EVEN IF WE KNEW OF POSSIBLE DAMAGES

10. Indemnification You agree to defend, indemnify, and hold harmless Palpable, its affiliates, and personnel from any claims, damages, or expenses arising from your use of Services, violation of these Terms, or infringement of any rights.

11. Termination

  • Either party may terminate at any time

  • We may immediately terminate for Terms violations

  • Upon termination, access ceases immediately

  • Provisions surviving termination: intellectual property, limitation of liability, indemnification, and dispute resolution

12. Dispute Resolution

  • These Terms are governed by California law

  • Disputes shall be resolved through binding individual arbitration under AAA rules

  • Class actions and jury trials are waived

  • Small claims court remains available for qualifying claims

  • Arbitration location: San Francisco, California

13. Export Compliance You comply with all export laws and regulations. You represent that you are not located in, or a resident of, any embargoed country or on any prohibited party list.

14. Force Majeure We are not liable for failures due to circumstances beyond reasonable control, including natural disasters, war, terrorism, strikes, or internet outages.

15. Modifications We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or in-app.

16. Severability If any provision is deemed invalid, the remaining Terms continue in full effect.

17. Entire Agreement These Terms, our Privacy Policy, and any supplemental terms constitute the entire agreement between you and Palpable.
